Article 1
Definitions and identity
‘Moraira Catering’ means the supplier of the agreed services. ‘Client’ means the individual or business entering into the agreement. A ‘consumer’ is a client acting for purposes outside their trade, business, craft or profession.
Article 2
Application and acceptance
These terms apply to every quotation, booking and agreement when made available before or at the time the contract is concluded. Any deviation must be agreed in writing.
If a specific written term in the quotation or booking confirmation conflicts with these terms, that specific term prevails. Mandatory Spanish consumer rights always continue to apply.
Article 3
Quotations and contract formation
Quotations are valid for 14 calendar days unless stated otherwise. The contract is formed by written acceptance by email, WhatsApp or signature and, where requested, receipt of the deposit.
The final number of guests must be confirmed in writing at least 5 working days before the service. If this is not done on time, Moraira Catering may rely on the last confirmed number.
Article 4
Prices, guest numbers and changes
The price is calculated from the agreed services, location and confirmed number of people. The quotation will state whether Spanish VAT/IVA is included or added separately.
After acceptance, prices will not be increased unilaterally except for a compulsory tax change or a change requested by the client. Additional consumption, hours, staff, rentals or guests are charged only when agreed or demonstrably supplied.
Article 5
Payment
For a total price of €1,000 or more, the deposit is 25% unless the quotation gives a different payment schedule. The balance is due at the time stated in the quotation or invoice; if none is stated, no later than completion of the service.
Late payment may carry statutory interest once the client is legally in default. For business clients, the interest and recovery costs under Spanish Law 3/2004 apply where relevant. Consumers will only be charged reasonable, lawful and evidenced recovery costs.
Article 6
Performance, access and delay
The client must provide safe and timely access to the venue and the agreed facilities, including water, electricity, workspace and any necessary permits. Delay caused by the client may lead to evidenced extra costs or an adjusted service.
If a serious delay makes performance reasonably impossible or compromises food safety, Moraira Catering may stop the affected part. Non-recoverable costs and services already performed may be charged to the extent permitted by law.
Article 7
Dietary requirements, allergies and food safety
Dietary requirements, allergies and intolerances must be reported in writing at least 5 working days before the service. Moraira Catering will provide legally required allergen information and assess which adaptations can be made safely.
Different allergens are handled in the kitchen. Despite careful procedures, cross-contact cannot be ruled out completely. A dish or service may be declined in the case of a severe allergy for safety reasons. This clause does not limit any legal food-safety right.
Article 8
Cancellation by the client
Catering and food services booked for a specific date fall within the statutory exception to the withdrawal right. The following cancellation policy therefore applies after final confirmation.
The amounts are a reasonable advance estimate of reserved capacity, preparation, staff, purchased or perishable products and non-recoverable costs. For consumers, compensation will never exceed the actual loss and costs attributable to the cancellation after deducting avoided or recovered costs. Amounts already paid are credited against the sum due.
More than 14 calendar days before the service: €25 administration charge.
From 14 to 8 calendar days before the service: 20% of the total price.
From 7 calendar days until more than 48 hours before the service: 50% of the total price.
Within 48 hours of the service or in the event of a no-show: 100% of the total price.
Cancellation must be made in writing by email or WhatsApp and is effective when received.
Article 9
Partial cancellation and additional guests
If the confirmed guest number is reduced by more than 10%, article 8 applies proportionally to the cancelled part. Smaller reductions will be assessed against costs already incurred.
Guests added less than 48 hours in advance can only be accepted when practically possible and food-safe. A reasonable additional price will be charged.
Article 10
Cancellation or force majeure by Moraira Catering
Moraira Catering is not liable for failure caused by an unforeseeable or unavoidable event outside its reasonable control within article 1105 of the Spanish Civil Code. The client will be informed as soon as possible and reasonable steps will be taken to reduce the impact.
Where possible, an equivalent alternative or new date will be offered. If the client declines or performance is permanently impossible, sums for unperformed services will be refunded in accordance with applicable law. If Moraira Catering cancels without force majeure, all statutory client rights remain available.
Article 11
Liability and damage
The client is responsible for damage culpably caused by the client or their guests to property belonging to Moraira Catering, staff or third parties.
Moraira Catering is liable under applicable Spanish law. Nothing in these terms excludes or limits liability for death or personal injury, wilful misconduct or gross negligence, a breach of mandatory consumer rights or food-safety obligations.
Article 12
Complaints
An immediately visible issue should preferably be reported during the event or as soon as possible so that a remedy can still be offered. Other complaints should be sent in writing promptly with a clear description and, where relevant, photographs or evidence.
This process does not shorten any statutory guarantee, liability or consumer right. Consumers may request the official complaint form of the Valencian Community.
Article 13
Spanish law, courts and language
The agreement is governed by Spanish law. Disputes will be submitted to the court competent under Spanish and European procedural rules. A consumer does not waive the court of their domicile, the place of performance or any other mandatory forum.
These terms are available in Spanish, Dutch and English. If they differ, the Spanish version prevails insofar as this does not restrict mandatory consumer protection or the interpretation most favourable to the consumer.
